Default M$ empire strike back@Vista's(now Win-7)users!!


M$ again does what it want..Strike it users...Basking on its early success of windows-7, it immediately strike the Vista's users who are now a proud(fraud?) owner of Windows -7 upgrade disks,license,,and eager to clean installing it..Most Vista users with a "full" license were eligible for an upgrade option wherein they could get Windows 7 for a discounted price.
Since the upgrade option is a cheaper way of getting the OS, it was a fairly attractive means of getting a licensed version of the product for less. Microsoft's EULA for upgrade discs explicitly states that must own a full version of a previous version of Windows if you want to use the upgrade
disc.
Microsoft has clarified as to how a clean install done on a blank hard drive from an upgrade install disc by an user who does not own a full license is in violation of the Windows 7 EULA. what this means is that when you do a clean install, you are no longer own a "previous version" and are hence breaking the terms of the EULA.
Also the term used by the M$ 'Full License"has still not clarified it. Is an OEM copy of XP on the original machine a "full" license? It's a needless confusion. If there is no distinction between OEM and retail in this instance...just say "licence", not "FULL licence". Yet again, it is someone from M$ needlessly confusing people. It would be very easy for someone to think 'FULL licence' referred only to a retail licence, and not an OEM.

So my dear friends if you have purchased the upgrade Win-7 disks and clean install it in your Hp /Compaq/Dell .. Wach out.. the BSA goons are already in your rooftop..Courtesy..Uncle Ball!!

On Acer site also I saw their info which tells that owners of vista ultimate will get an upgrade free of cost. Probably upgrade means upgrade and not clean install.http://www.acer.com/windows7upgrade/

of course it mean UPGRADE only. So in case a user has vista installed already and got Win 7 upgrade disk then he can upgrade to Win 7 easily. But the next time he formats the PC/lappy and wants to do a clean install he cannot using that disk!

There are several ways to cleaninstall Windows-7 with upgrades disks..upgrade from vista to win-7 is useless and counter productive.. better they use vista with sp2 with out the upgrade option

@vaithy, I don't understand this. When MS labelled the disc as UPGRADE disc, why are you thinking of a clean install?

If you are not able to understand the difference between upgrade and full version, then nobody can do anything.

Upgrade: does not support clean install and needs windows vista or supported Xp.
Full: does clean install and no need to have license of earlier OS.

It's as simple as that.

you want to do a clean install, get full Retail version.

You can do an upgrade from OEM version but again, you cannot do a clean install if you have Vista OEM and bought windows 7 upgrade edition.

Out there millions users don't want to given up the windows XP easily to the new operating system..what I surmised from the recent clarification from Microsoft is users who has the valid windows license may indeed 'clean install' on the hard disks after formating the Hard disks of previous OS..But users don't want to lose XP.. so they use upgrade disks to install the WINDOWS -7 in another partition which according to MS is illegal

if users don't want to lose XP, that is their problem. if they want to stick to aging OS, what can MS do?

It's the same with any paid software. you either keep the old one and install new one alongside or you overwrite old one with new one (either by upgrade or full install).

Apple has completely abandoned PowerMac users for their Leopard and Snow Leopard and that is fine.

But when MS says upgrade version is for upgraders and full version is for full retail, it's bad???

What kind of judgement is this? Being a critic is okay but criticizing everything is nonsense.

also, those who are using XP, have they ever tried to test their apps on Windows 7? Windows 7 RC was available for everyone along with XP mode. Did anyone ever thought of giving that a serious try? i saw it in action and felt that it is a perfect solution for the compatibility issues.

just reading some junk articles on the net and making decision is ridiculous.

wow. this is amazing. what makes you say that it is useless and counter-productive?? Do you know that it is the easiest way to upgrade to windows 7 without losing applications and settings?

@vaithy, if you want to use WinXP and Win7 as dual boot on your system, you should have full licenses for both (or 2 full licenses of XP and 1 upgrade license of 7). This has been the policy for pretty much every commercial software.

Depends on the manufacturer. some provide the installaiton through service partition and some give physical media.

Well this is the obvious disadvantage of paid proprietary software which is licensed under EULA because the company owns the software and you can use the software only in the way THEY WANT IT for you to use.
That's why I never purchase proprietary software and use only free and open source software and proprietary software only if it's actually free of cost like Opera. Why waste money with paid proprietary software? If you have the money donate it to Open Source Movement.
Of course, if you require such software you have to bear with this rather moronic sense of licenses, but this doesn't matter to enterprises I guess, since they have enough money to spare.
As for people who dont like these license terms, simply use to alternative means of getting the software ( ) and save the money and if possible donate if you want to.

EDIT:
I think this should be thought out as an Exchange offer type deal. Isn't it?
Personally I always find upgraded OSes slower and more bloated. Seriously it would have been better if they offered forfeiting older license and disks and getting, new OS for clean install, after a one time choice of upgrade of course, so that the first time user wants to have the new OS with upgrade, she will have but in the future if she formats, she can have a clean install.

Please do understand that the Windows 7 Upgrade packs will NOT be sold here in India. Only those who purchased a Vista loaded laptop and are eligible to a Windows 7 upgrade courtesy their OEM will be getting Upgrade discs.

The prices of Windows 7 in India are way cheaper than that in the Western world.

AFAIK, Dell will ship you a upgrade DVD of windows 7 but you need register for that before you get it. Check the dell site for more details.

What's the big fuss about? The upgrade discs aren't even available in India. In the western world its creating a lot of controversy because Microsoft kind of tricked people into buying upgrade editions of Windows at huge discounts. Most of these people thought that they were getting full editions at the discounted price.

So, Paul Thorrot got pissed off and shared the hack with everyone. And that created all the controversy.

Anyway, it is legal to perform a clean install using the hacks as long as you own a Vista or XP license.
