Gay sex decriminalised in India
Source: http://news.bbc.co.uk/2/hi/south_asia/8129836.stm
A court in the Indian capital, Delhi, has ruled that homosexual intercourse between consenting adults is not a criminal act.
The ruling overturns a 148-year-old colonial law which describes a same-sex relationship as an "unnatural offence".
Homosexual acts were punishable by a 10-year prison sentence.
Many people in India regard same-sex relationships as illegitimate. Rights groups have long argued that the law contravened human rights.

And a follow up.......Kerala church won't allow gay sex to be legalised
Source: http://ibnlive.in.com/news/kerala-ch...d/96166-3.html
The Kerala Catholic Bishops Conference (KCBC) on Thursday said it would oppose legalisation of gay sex after the Delhi High Court struck down Section 377 of the Indian Penal Code (IPC) that termed homosexuality a criminal act.

B/W, I was thinking the law is passed only by Delhi High Court not by Supreme Court. So I don't think think it will be a pan India affect. For that order needs to come from Supreme Court.

SC takes up plea against gay sex, issues notice
Source: http://ibnlive.in.com/news/sc-takes-...e/96719-3.html
The Supreme Court on Thursday issued notices to the Centre, the Delhi government and the NGO Naz Foundation seeking their stand on a lawsuit challenging the July 2 verdict of the Delhi High Court decriminalising gay sex.
A bench of Chief Justice K G Balakrishnan and Justice P Sathasivam issued notices on the lawsuit filed by a Delhi advocate Suresh Kaushal. The bench has sought replies of the various parties by July 20, the next of hearing of the matter.
Challenging the high court verdict, Kaushal contended before the bench that the high court had delivered a "perverse ruling" that would threaten the natural balance of society.

Re: Gay sex decriminalised in India
Good!
More the number of pure gays in India, less the number of Children, less the population. Excellent.
Come Indians, most of you become gays; finally the population problem would end.
On a serious note, I think this is good, since the law seemed way too antiquated. If a man loves a man or woman loves a women, they didn't deserve a ten year jail term.
Though I daresay their must be vigilance against sexual harassment by gays.

Baba Ramdev is just that, a Baba. He's entitled to his opinions. As pointed above, there is no need to give a ten year jail term for homosexuality. Don't legalise gay marriage, OK, but don't criminalise gays and gay relationships.

Re: Gay sex decriminalised in India
^^^ ( liverpool ) +100
anyway its individual choice to be a straight or homo... i dont think any gov or person or groups( ram dev / catholic/... ) have the right to tell them to stop ...
i think these rules(controversial ) should be encouraged and we shouldnt be tied down to the old belief.... and grips or gundaaa`s.... or any religious A$$ H0LES
@ nucleuscore
wht r u saing ? u want the realationship to be legalised and not marriage ?
wht is it going to do ? it neither way...
again i am saying .. its a individuals choice..
as law states when two adults consent they can marry... i dont find any fault in it...

Re: Gay sex decriminalised in India
Just a step. Surprised that 377 was revoked. Don't think any gay person has been sent to prison for 10 years, just for being gay. The police do harass them however. Sec. 377 was the part of the IPC that criminalised things like bestiality as well. And it has just been decriminalised - not really giving any legal rights to the LGBT community. Would have been more helpful if India allowed domestic partnership rights, and passed laws of that kind. That would help unmarried couples, as well as same sex couples.

Re: Gay sex decriminalised in India
Though this is a big step forward in my opinion it really doesn't make a difference unless gay marriage is legalize. Well this controversy by the way will result in some bad bad discrimination in the coming days you'll see. I at least expect something headline worthy to happen out of this.

Re: Gay sex decriminalised in India
All you guys who are going gaga over this issue, just for second, think what would have been going to the lives of their parents when it comes out that their lovely boy is gay.
When there is still demand for fairer brides and cosmetic creams ads, then we come out in support of these acts where deep down we are all racists.

Re: Gay sex decriminalised in India
Once children reach adulthood it's their choice. As a parent you've done your job, then it's up to them. In India parents still don't know when to let go.

Re: Gay sex decriminalised in India
I totally agree. The human mind is a maze. You cant get what is going on in a homosexual's mind. From the outside it may seem hideous, but then no human is supposed to be the same. What about people who have been born with deformities?? Do we spit at them?? We pity them but life goes on. Being homosexual is a brain "malfunction" and whatever that ramdev babaji or whoever says its curble is bluffing. Making a homo straight is like decieving yourself to believing ur a girl(if ur a guy that is).

Parents in india only know that the child is adult enough, when they are PWNed by their child.
Being a gay is one's personal aspect. If his partner agrees to mate with him. Who are we supposed to intervene in that matter. We can only talk, if he is participating homosex in a brothel or forcing someone to do. With both being adults, accepted to have sex, and mating in a place where there is no disturbances for the public, who are we to ask? them.

Re: Gay sex decriminalised in India
Absolutely. The world has progressed and so should India. But then, since homosexuality is kinda "abnormal" it should be refrained from being practiced in public.

Well the parents would probably end up disillusioned and probably "badnam" in their locality and victim of vicious taunts.
However at least legalization of homosexuality prevents their kids and them from legal hassles and police blackmail.
@cyborg:
It's not that simple. How old are you BTW?
In a country where inter caste, inter religious and even other love marriages are looked in a abnormal way, homosexuality is a different level altogether.

Incest: Even under the previous law (i.e. immediately before the passing of this verdict), incest was not illegal. Current verdict makes no difference.
Bestiality: The current verdict legalizes sex between consenting adults. Unless you are suggesting that you can talk to the animals and take their consent, you can rest easy. Also, current verdict retains the word "animal" within the section, clearly making bestiality illegal.
You can sleep easy now.
