cant access marketplace on wp7..says not available in india

so i got a htc mozart from my office and it has windows 7 installed(not mango) anyways ive created a windows live id but whenever i try to access the market place it gives me an error saying that marketplace isnt available in your region/country..is it a problem with my phone or is the market really not available in india??

Reset phone (backup data via zune first) and when selecting a country, select USA... I did that and so have access to all apps as well as XBox Live...

Why select India from the list when using a phone built for USA?
